Terms of Service Albert Paradise
Effective Date: July 24, 2025
1. Introduction
Welcome to Port Albert Paradise (“we,” “us,” “our”). These Terms of Service (“ToS”) govern your use of our website at https://portalbertparadise.com (the “Site”) and any bookings or rentals you make through it. By accessing or booking through the Site, you agree to these ToS.
2. Definitions
Guest: the individual making a booking on the Site.
Property: any vacation rental listed on our Site.
Booking: a confirmed reservation of a Property.
3. Booking & Payment
3.1 Availability & Confirmation
All bookings are subject to availability. Once you select dates and pay the deposit (if required), you’ll receive a booking confirmation by email.
3.2 Rates & Fees
Rates shown include the nightly rate, cleaning fee, and HST/GST where applicable. Additional fees (e.g. security deposit, pet fee) will be clearly disclosed at time of booking.
3.3 Payment Schedule
• Deposit: 25% of total rent due immediately to secure your booking.
• Balance: remaining 75% due 30 days before check‑in.
If you book within 30 days of arrival, the full amount is due at booking.
4. Cancellations & Refunds
4.1 Guest Cancellations
More than 30 days before check‑in: full refund minus a $50 administration fee.
14–30 days before check‑in: 50% refund of total rent.
Less than 14 days: no refund.
4.2 Owner Cancellations
If we must cancel for reasons beyond your control (e.g. property damage, force majeure), you’ll receive a full refund or the option to rebook comparable dates.
5. Guest Responsibilities
• Keep the Property clean and treat it with care.
• Comply with all posted house rules (no parties, noise curfew at 10 PM, etc.).
• Report any damage or maintenance issues within 24 hours.
• Ensure the number of Guests does not exceed the maximum occupancy.
6. Check‑In & Check‑Out
• Check‑in: after 3 PM local time.
• Check‑out: by 11 AM local time.
Early/late requests may incur additional fees and must be approved in writing.
7. Security Deposit & Damages
A refundable security deposit of $500 (or as listed) is collected at booking. We’ll inspect the Property after check‑out and, if no damage is found, refund your deposit within 7 business days. If damage or excessive cleaning is required, we reserve the right to deduct repair/cleaning costs from your deposit and will provide an itemized statement.
8. Liability & Disclaimers
8.1 We act only as an intermediary between you and the Property Owner. We do not own or manage the Properties.
8.2 To the fullest extent permitted by law, we disclaim all liability for injury, loss or damage to persons or property arising from your stay.
8.3 You agree to indemnify and hold us harmless from any third‑party claims related to your booking or stay.
9. Insurance
We strongly recommend you carry travel insurance covering cancellation, interruption, medical expenses, and personal liability.
10. Privacy Policy
Your personal information is handled in accordance with our Privacy Policy. By booking, you consent to its terms.
11. Intellectual Property
All content on the Site (text, photos, logos) is owned by us or our licensors. You may not reproduce or use it without our prior written permission.
12. Amendments
We may update these ToS at any time. The “Effective Date” at the top will change. Continued use after changes means you accept the new ToS.
13. Governing Law & Dispute Resolution
These ToS are governed by the laws of Ontario and Canada. Any dispute arising under or in connection with these ToS shall be resolved in the courts of Ontario.
